Terms & Conditions
These Terms & Conditions constitute a contract between EBI Clothing, operated under the legal entity EBI SAS, and any individual or entity wishing to make a purchase via the website ebiclothing.com (hereafter referred to as "the Buyer"). The website is the exclusive property of EBI Clothing and its associated directors, and is hosted via Shopify, with all related rights reserved.
Reproduction of all or part of the Site is strictly prohibited without prior written permission. However, hyperlinks to our Site are permitted without special request.
1. Acceptance of Terms
By placing an order, the Buyer acknowledges having read and accepted these Terms & Conditions without reservation.
These conditions govern the contractual relationship between EBI Clothing and the Buyer. They take precedence over any other conditions unless previously agreed in writing by both parties.
EBI Clothing reserves the right to amend these Terms & Conditions at any time. The applicable conditions will be those in force at the time the order is placed.
2. Products
Most of the products sold on our site are limited editions, unique pieces, or reworked vintage items.
We strive to display embroidery colors and styles as accurately as possible in our product photos. However, slight variations may occur due to factors beyond our control (screen settings, lighting, color rendering).
All items are subject to availability and geographic delivery zones, as handled by La Poste Colissimo.
If a product becomes unavailable after an order has been placed, the Buyer will be notified via email. They may then choose a partial delivery or cancel the order. If payment has already been processed, a refund will be issued immediately. Refund timing depends on the payment method (3–8 days for direct debit cards; end-of-month for deferred charges).
3. Orders
Orders placed through our website are confirmed and timestamped automatically and serve as proof of their content and timing.
Confirmation of order acceptance will be sent via email to the Buyer. The sale is considered concluded once this confirmation is received.
EBI Clothing reserves the right to cancel any order in the event of a payment-related dispute.
The Buyer is solely responsible for the accuracy of shipping information provided. EBI Clothing cannot be held responsible for failed deliveries due to incorrect details.
4. Delivery
Once an order is confirmed, EBI Clothing commits to shipping within a maximum of 20 business days, both for domestic (Belgium) and international deliveries.
Delays caused by customs clearance or pending payment of import duties by the customer are not included in this timeframe.
For deliveries outside of Belgium, the Buyer is responsible for any applicable import duties, taxes, or VAT in accordance with the laws of the destination country. EBI Clothing is not liable for the non-payment of these charges.
Deliveries outside the European Union are handled by international postal services via Colissimo.
Products are shipped at the Buyer’s risk. Upon delivery, the Buyer has 48 hours to report any damage to the parcel directly to the shipping carrier.
5. Pricing
All prices are listed in Euros (€) and include applicable taxes (TTC).
The product price displayed does not include shipping costs.
The total price shown during checkout includes the product(s), applicable taxes (e.g., VAT for France and the EU), and any handling or shipping charges.
EBI Clothing reserves the right to update prices at any time. However, the applicable price will always be that which appears at the time of order confirmation.
For deliveries outside the EU, additional customs duties or local taxes may apply. These charges are the sole responsibility of the Buyer.
6. Payment
The final price charged is that which appears in the order confirmation email.
All payments are due at the time of order and can be made securely via platforms such as PayPal and Stripe.
7. Disputes
This contract is governed by Belgian law.
EBI Clothing shall not be held liable for material, immaterial, or bodily harm resulting from improper use of the products sold.
Our liability is limited to the total amount of the order and does not extend to possible errors or omissions in product descriptions or photos.
In the event of a dispute, the Buyer is encouraged to seek an amicable resolution with EBI Clothing before taking legal action. The Buyer may consult a consumer mediator, a professional organization, or another advisory service.
If no agreement is reached, only the competent courts of Brussels (Belgium) shall have jurisdiction, regardless of the delivery location or payment method used.
8. Legal Notice & Data Protection
The collection of personal data is necessary for order processing, shipping, and invoicing.
In accordance with the French law "Informatique et Libertés" of January 6, 1978, Buyers have the right to access, modify, correct, or delete their personal data. These rights may be exercised by contacting EBI Clothing.
EBI Clothing commits to never sharing customer data with third parties for commercial purposes, whether free or paid.
